This Agreement, herein referred to as the “Liability Waiver”, is made between

who is hereby defined as the CLIENT, and JB-Nets Broadband Services, who is hereby defined as the COMPANY. This Waiver is the CLIENT’S agreement to allow the use of COMPANY equipment in the confines of the CLIENT’S property.Untitled Title

The Details

  1. By signing this Waiver, I grant permission to JB-Nets Broadband Service with the use of their Company’s digging equipment in the confines of my property. I acknowledge and understand that JB-Nets Broadband Services has followed all protocol and has contacted 811, Call Before You Dig, to properly locate and confirm all known possible wires, conduit, waterlines, etc. If there should be anything outside the extent of what 811 is able to pinpoint, and I know where they are located, I understand it is my responsibility to notify and reveal the position to JB-Nets Broadband Service’s Equipment Operator(s) before any digging begins.


  2. I understand and agree that if I did not notify the Company’s Equipment Operator(s) of anything that was outside of the extent found using 811, and it should become damaged, I assume full responsibility of the damage and JB-Nets Broadband Services will not be held responsible for any repairs or replacements.


  3. I understand that I am not permitted to operate any equipment used by the Company, and that I will maintain a safe distance away from the machinery while both in use and stationary. If I prove negligent and infringe on this, and any equipment becomes damaged because of it, I agree to be held responsible for any equipment repair or replacement cost that may be accrued.


  4. I acknowledge that JB-Nets Broadband Services has informed me in accordance with this waiver to stay a safe distance away from the work site while machinery is in operation. If I prove negligent in adhering to this and I am injured, I understand that JB-Nets Broadband Services is not at fault nor responsible for any medical expenses that may accrue. 


  5. I understand that if I have any questions or concerns with the use of equipment on my property that I should address and make them clear preferably before work begins. I am aware that very minor damage may occur to the property while machinery is in use, however, JB-Nets Broadband Services will do as much as they are able to restore things back to the way they were before the use of equipment.

I have carefully read over this waiver and fully consent to the acknowledgments and risks mentioned within this agreement, and agree to the use of JB-Nets Broadband Service’s machinery on my property.
