I hereby acknowledge and agree to participate voluntarily in the aerial arts activities organized by Levity Arts at the Creative Convergence event held at Gasworks Park on Thursday, July 17, 2025 and Friday, August 15, 2025.
In consideration of being permitted to participate in the aerial arts and acrobatics activities, I hereby acknowledge and agree to the following:
Assumption of Risk: I understand that participating in aerial and acrobatics arts involves inherent risks, including but not limited to equipment failure, and bodily injury. I acknowledge that these risks cannot be eliminated, and I voluntarily assume all such risks associated with my participation.
Physical Condition: I certify that I am physically fit and have no medical conditions that would prevent me from safely participating in aerial arts activities. I acknowledge that it is my responsibility to inform the event organizers of any medical conditions or physical limitations that may affect my participation.
Release of Liability: I hereby release, waive, discharge, and covenant not to sue Levity Arts, Seattle Fire Arts, or Yerbana, its officers, directors, employees, volunteers, agents, and representatives (collectively referred to as "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or any property belonging to me, whether caused by the negligence of the Released Parties or otherwise, while participating in aerial arts activities at the pop-up circus event.
Indemnification: I agree to indemnify and hold harmless the Released Parties from any and all liabilities or claims made by third parties arising out of my participation in the aerial arts activities, including but not limited to claims for bodily injury, property damage, or wrongful death.
Photo and Video Release: I grant permission to Levity Arts to use photographs, videos, or other media of me taken during the event for promotional purposes, without compensation or further approval.
Compliance with Rules and Instructions: I agree to comply with all rules, regulations, and instructions provided by the event organizers, including but not limited to safety guidelines and equipment usage instructions.
Governing Law: This waiver and release shall be governed by and construed in accordance with the laws of Seattle, WA.
I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
