PazFit Waiver

PAZFIT TOTAL RELEASE OF LIABILITY, WAIVER, AND SERVICE AGREEMENT (Oregon)

1. ACKNOWLEDGMENT OF RISK

I understand that participation in physical exercise, fitness training, and related activities involves serious

risks, including injury, permanent disability, or death. I voluntarily assume all risks, including risks arising from

my own actions or inactions and the actions of others.

2. RELEASE AND WAIVER OF LIABILITY

I fully release, waive, discharge, and covenant not to sue PazFit, its owners, employees, contractors, and

agents (collectively 'Released Parties') for any and all claims, damages, injuries, or death, whether known or

unknown, arising from or related to participation in any PazFit program, except where caused by gross

negligence or intentional misconduct.

3. NO REFUNDS

I acknowledge that all fees paid for services, programs, or sessions are non-refundable, under any

circumstances.

4. MEDICAL CLEARANCE

I certify that I am physically able to participate in fitness activities. I understand it is my responsibility to

consult a physician prior to participation if I have any health concerns.

5. EMERGENCY CONTACT & MEDICAL CONDITIONS

Please provide emergency contact information and any known medical conditions or limitations.

6. INDEMNIFICATION

I agree to indemnify and hold harmless the Released Parties from any claims, demands, or actions brought

by myself, my family, heirs, or assigns related to my participation in fitness activities.

7. RIGHT TO REFUSE OR CANCEL SERVICES

PazFit reserves the right to refuse or cancel services at any time, for any reason, without notice or refund.

This includes, but is not limited to, failure to follow safety instructions, inappropriate conduct, or failure to

comply with program rules.

8. GOVERNING LAW

PAZFIT TOTAL RELEASE OF LIABILITY, WAIVER, AND SERVICE AGREEMENT (Oregon)

This Agreement is governed by the laws of the State of Oregon.

9. SEVERABILITY

If any part of this Agreement is held invalid, the remainder remains in full legal force and effect.

ACKNOWLEDGMENT OF UNDERSTANDING

I have read this Agreement, understand its terms, and sign it voluntarily, knowing I am giving up substantial

rights, including the right to sue.

Waiver and Release of Liability

In consideration of being allowed to participate in any way in the fitness classes, personal training, and related events (hereinafter referred to as "Activities") at PazFit, I, the undersigned, agree to the following:

Assumption of Risk: I understand that participation in the Activities involves inherent risks, including but not limited to physical injury, emotional distress, and even death. I voluntarily assume all such risks, both known and unknown, and accept full responsibility for my participation.
Release and Waiver: I hereby release, waive, discharge, and covenant not to sue PazFit, its owners, employees, agents, and representatives (hereinafter referred to as "Releasees") from any and all liabilities, claims, demands, actions, or causes of action that may arise from my participation in the Activities, including those caused by the negligence of the Releasees.
Indemnification: I agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or cost they may incur due to my participation in the Activities, whether caused by the negligence of the Releasees or otherwise.
Medical Clearance: I affirm that I have consulted with a qualified healthcare professional regarding my ability to safely participate in the Activities. I understand that it is my responsibility to monitor my own health and well-being during participation.
Photographic Release: I grant permission to PazFit to use photographs, videos, or other media taken during the Activities for promotional purposes without compensation or further approval.
Governing Law: This waiver and release shall be governed by and construed in accordance with the laws of the state in which PazFit is located.
Severability: If any provision of this waiver and release is found to be unenforceable, the remaining provisions shall remain in full force and effect.

I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY AND FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE THE RELEASEES. I AM SIGNING THIS WAIVER AND RELEASE FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
