(Nevada – Minor or Adult Camp Participant)

I, on behalf of myself and/or my minor child, including my personal representatives, heirs, assigns, spouse, estate, and next of kin, hereby acknowledge and agree to the following:

I understand and acknowledge that participation in basketball training, camps, clinics, competitions, conditioning, scrimmages, and related athletic activities involves inherent and significant risks, including but not limited to bodily injury, concussion, paralysis, illness, exposure to communicable diseases (including but not limited to COVID-19), permanent disability, death, emotional distress, and property damage.

I knowingly and voluntarily assume all risks, both known and unknown, foreseeable and unforeseeable, associated with participation in these activities, including risks arising from the negligence of the Releasees, other participants, coaches, trainers, staff, spectators, equipment, facilities, transportation, and conditions of the premises.

In consideration for being permitted to participate in any camp, clinic, training session, event, competition, or related activity, I hereby release, waive, discharge, covenant not to sue, and agree to hold harmless Born 2 Ball Basketball Academy, Cycle Collective LLC, Kristopher Obaseki, and all affiliated entities, sponsors, partners, facility owners, schools, employees, officers, directors, coaches, trainers, volunteers, independent contractors, agents, representatives, successors, assigns, and related persons or entities (collectively, the “Releasees”) from any and all claims, liabilities, demands, causes of action, damages, losses, costs, expenses, or compensation for injury, illness, death, or property damage arising out of or related to participation in any activity, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted under Nevada law.

I further agree to indemnify, defend, and hold harmless the Releasees from and against any and all claims, liabilities, damages, judgments, costs, or expenses, including attorney’s fees and court costs, arising out of or related to my and/or my child’s participation in any camp or related activity.

I acknowledge and agree that this Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Nevada. If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

I certify that I am physically able, or that my child is physically able, to safely participate in these activities and understand that the Releasees are not responsible for providing medical insurance or medical coverage of any kind.

I understand that in the event of an emergency, reasonable efforts will be made to contact the participant’s emergency contact; however, I authorize the Releasees to obtain emergency medical treatment deemed necessary for myself and/or my child. I understand and agree that I am solely responsible for all medical expenses incurred.

I certify that I have carefully read this Waiver and Release of Liability, Assumption of Risk & Indemnity Agreement, fully understand its contents and legal significance, and understand that I am waiving substantial legal rights, including the right to sue. I acknowledge that I am signing this Agreement freely and voluntarily without inducement, assurance, or guarantee of any kind and intend my signature to serve as a complete and unconditional release of liability to the fullest extent permitted by Nevada law.

If the participant is under 18 years of age, I certify that I am the parent or legal guardian of the participant and that I have the legal authority to sign this Agreement on behalf of the minor participant. I agree to all terms and conditions of this Agreement both individually and on behalf of the minor participant.

I hereby grant the Releasees the irrevocable right and permission to photograph, video record, livestream, and otherwise capture my and/or my child’s name, image, likeness, voice, and appearance during participation in camp activities. I authorize the Releasees to use such materials for promotional, advertising, marketing, social media, website, broadcast, and other lawful business purposes without compensation, inspection, or additional consent.

I understand and acknowledge that all registrations, deposits, and payments made for this event are final and non-refundable under any circumstances, including but not limited to injury, illness, scheduling conflicts, dismissal from camp, travel issues, weather conditions, or inability to attend. By signing below, I acknowledge and agree to this non-refundable policy.

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Nevada. Any legal action arising from or related to this Agreement or participation in camp activities shall be brought exclusively in a court of competent jurisdiction located in Washoe County, Nevada.
