Please allow 1 week for the organizer to arrange the transfer of deposit.
You understand that if there are any changes to your menus or products, you need to inform the organizer or risk being removed from participating in the market.
Definitions
Application and Acceptance
Participation Fee
The stallholder agrees to pay a $225, $200 or $80 as required inclusive of deposit fee upon confirmation of your participation, which only $100 will be refunded for food stall/van vendors and $40 will be refunded to non food stall after the event. The participation fee may be different to food stalls.
Stallholder Responsibilities Fees & Payment
Stall Fee: The fee for each stall is as per listed per market day.
Payment Terms: Payment must be made by 21st September 2025 via Bank Transfer
Refund Policy: If the Stallholder cancels participation more than 14 days before the market date, a full refund will be issued. Cancellations within less than 14 days of the market will incur a cancellation fee of $40.
Stall Allocation
The stall space allocation is at the Market Organisers' sole discretion.
Stallholders are not permitted to sublet or share their allocated stall space without prior approval from the Market Organisers.
Products & Services
Readiness
o Bump-In Time: From 0700hrs onward. All vendors must arrive on time. Late arrivals may incur penalty charges.
o Pack-Down Time: From 1430hrs onward.
o Early Departure: Food stallholders are strictly prohibited from leaving or packing down prior to the designated pack-down time
Stall Setup
The Stallholder must provide all necessary equipment for their stall, including tables, marques, chairs, etc.
Stall Size 3mby3m. If additional space is required, please notify the Market Organizers and extra charges applies.
All Stall holder to bring your own marquee 3mx3m with weights must be used minimum 20kg per leg- nil pegs allowed, also bring own tables and chairs.
The Organizer reserves the right to suspend or terminate trading activities of any stallholder, their staff, volunteers, or contractors if their conduct, products, or overall operations are deemed unsatisfactory, unsafe, or in breach of event policies.
The stallholder must ensure cleanliness, cleaning up the group space within 5 metres of radius in front, back and side of your stall. Your deposit will be penalised if you leave the spot without proper cleaning up.
The Market Organizers are not responsible for any loss, theft, or damage to goods.
The organizer Nursaz.co reserves the right to allocate your stall to any location within the event areas without further notice.
The stallholders must ensure all approved products are ready for sale to visitors from 0900hrs to at least 1430hrs on the event day.
Vehicles and Parking
Vendors are permitted to use the event area for bump-in and bump-out purposes only. Once unloading is complete, all vehicles must be promptly moved and parked in the nearest designated car park. No vendor vehicles are to remain within the market premises during trading hours.
Media and Marketing
o The organizer will take some photographs, video for promotional and marketing purposes. By participating in this market, the stallholder has granted permission for the organizer to include in our promotional media.
Insurance
The Stallholder must maintain Public Liability Insurance with a minimum coverage of 10 million , and a copy of the insurance certificate must be provided prior to setup.
Product Liability Insurance may be required if you are selling products that could cause harm or injury to consumers.
Compliance with Laws
The Stallholder agrees to comply with all local council regulations, including those related to health and safety, consumer protection, and any other applicable laws.
Food Stallholders must adhere to food safety regulations, including having a Certificate of Food Premises Registration and Food Trader Permit.
Non-food vendors must ensure that their products meet the legal requirements for sale and comply with Australian Consumer Law.
Health & Safety
The Stallholder is responsible for ensuring their stall area is safe and free from hazards.
A hand sanitizing station must be available at all food stall.
The food stallholder must have a designated fire extinguisher or fire blanket if required.
Weather Conditions or Weather Contingency
The Tarneit Farmers Market operates in all weather conditions unless the Market Organizers deem the weather unsafe.
If the weather is unsuitable for public safety (e.g., extreme weather events such as storms, high winds, or flooding), the Market Organizers may cancel the market.
In the event of cancellation due to weather, the Stallholder will be notified 5 hrs before the event starts or may be closed early. This will be communicated via all media platforms.
The Stallholder will be provided options either to request a 50% refund or fee transfer to a future market organised by Nursaz.co subject to availability and confirmation.
If the market has to be rescheduled due to adverse weather conditions, stallholders are required to confirm availability for next event. If vendors cannot attend the rescheduled event, the organizer will offer a credit transfer rather than payment refund.
If a Stallholder chooses to cancel their participation due to weather conditions before the market is officially cancelled, no refund will be issued.
Stallholder are advised to bring a first aid kit in case of accident due to extreme weather.
During extreme heat e.g. temperature >38 degree Celsius, stallholder are encouraged to bring enough shade, water, cooling devices, avoid damager of product and use hats/sunscreen.
Stallholder's Responsibility in Severe Weather
The Stallholder agrees to take precautions against adverse weather, including securing products and equipment against wind, rain, or other weather conditions.
The Stallholder is responsible for providing weatherproof coverings (e.g., tents, tarps) to protect their stall and products.
The Market Organizers will not be held liable for any damages to goods, equipment, or personal injury caused by weather conditions.
Conduct & Behaviour
The Stallholder must conduct themselves in a professional manner and be courteous to customers, other traders, and the Market Organizers.
Any disruptive behaviour, failure to comply with market rules, unacceptable noise pollution or damage to property may result in removal from the market without refund.
The Stallholder must not sell prohibited or restricted goods, including but not limited to counterfeit products, illegal items, or goods that violate the intellectual property rights of others.
Market Cancellation or Suspension
The Market Organizers NURSAZ.CO reserve the right to cancel or suspend the market for any reason, including but not limited to force majeure events (e.g., natural disasters, public health emergencies). In such cases, a full refund will be issued.
If the Stallholder fails to attend the market without prior notification, no refund will be issued.
Liability and Indemnity
The Stallholder agrees to indemnify and hold harmless the Market Organizers NURSAZ.CO, their agents, and employees from any claims, liabilities, losses, or damages arising from their participation in the market, including those related to personal injury, property damage, or product liability.
Termination of Agreement
Either party may terminate this agreement with 14 days of written notice.
The Market Organizers reserve the right to immediately terminate this agreement if the Stallholder is found in breach of any terms and conditions.
General Terms
These terms and conditions are governed by and construed in accordance with the laws of Victoria, Australia.
If any part of this agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Changes to Terms and Conditions
o The Market Organisers may update these terms and conditions with prior notice to Stallholders.
o By submitting the application and participating in Tarneit Farmer's Market , the Stallholder acknowledges that they have read, understood and agreed to these terms and conditions.
o I agree to abide by the rules and regulations of the Tarneit Farmer's Market , as outlined in the vendor guidelines and Terms and Conditions.
